Terms of sale

1. Purpose
These general terms of sale apply to all orders placed by consumers on meltamug.fr. They are drawn up in French. Placing an order implies acceptance of these terms. The applicable version is the one online on the day of the order.
2. Seller
MeltaMug is the trading name of Aboubakar Haidara, sole trader (EI), micro-entrepreneur, 8 rue Gandon, 75013 Paris, France, SIRET 923 400 550 00011. Email: m.haidara75@laposte.net. Phone: +33 6 19 44 95 92. Full details are available in the legal notice.
3. Products
The essential characteristics of each product are shown on its product page. Items shown in photos for presentation purposes (chocolate, food, candle, fork, tableware) are only supplied if they are expressly stated as included on the product page. Products are offered subject to availability from our supplier. If a product becomes unavailable after your order, you will be informed and refunded.
4. Prices
Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code (CGI): no VAT is added to the displayed price. Shipping costs are added to the price of the products.
Shipping costs are shown before you confirm your order. For deliveries outside the European Union, customs duties or import taxes may be charged by the destination country. They are not included in the price and are payable by the recipient.
5. Ordering
To order: choose your products and add them to the cart, then click “Check out”. Enter your contact details and delivery address, choose the delivery method, then check the order summary. You can correct your information at every step before payment. The contract is concluded when you confirm payment. A confirmation email summarising the order is then sent to you. Keep it, as it serves as proof of your order.
6. Payment
Payment is made online, using the methods offered at checkout, through Shopify’s secure payment solution. Payment is charged when the order is placed. MeltaMug does not have access to your full card number.
7. Delivery
We deliver to addresses in the countries offered at checkout. The applicable costs are shown before you confirm your order. Details are set out in our shipping policy.
Delivery times, from order confirmation: 1 week in metropolitan France, under 2 weeks in the European Union, 2 weeks to other countries, including French overseas territories. The applicable delivery time is shown again at checkout.
Orders are prepared and shipped by our partner supplier. An order with several items may arrive in several parcels. A tracking number is sent to you as soon as it is available.
In the event of a delay, you may ask us to deliver within a reasonable additional period. If delivery does not take place within that period, you may terminate the contract in writing (article L216-2 of the French Consumer Code). You will then be refunded all sums paid within 14 days at the latest.
The risk of loss or damage passes to you when you, or a third party designated by you, take physical possession of the products (article L216-4 of the French Consumer Code). If a parcel is damaged or incomplete, contact us promptly with photos.
8. Right of withdrawal
You have 14 days to withdraw from the contract without giving any reason. This period starts from the day you, or a third party designated by you other than the carrier, receive the goods. For an order delivered in several parts, it starts from receipt of the last item. If the period ends on a Saturday, Sunday or public holiday, it is extended to the next working day.
How to exercise your right:
- Online, from your customer account: Withdraw from the contract here. Log in with the email address used for your order, then select the order concerned.
- Or by sending us, before the period ends, the form below or any other unequivocal statement, by email to m.haidara75@laposte.net.
You must return the goods no later than 14 days after informing us of your decision, to the address given when your request is confirmed. Return shipping costs are payable by you.
We will refund all payments received, including the initial delivery costs, within 14 days of the day we are informed of your decision. Any extra cost for a delivery method more expensive than the standard one is not refunded. We may withhold the refund until we have received the goods or you have provided proof of shipment, whichever is earlier. The refund is made using the same payment method as used for the order.

9. Legal guarantees
Legal guarantee of conformity
Under articles L217-1 et seq. of the French Consumer Code:
- You have 2 years from delivery of the goods to claim under the guarantee.
- For new goods, any defect that appears within these 2 years is presumed to have existed at the time of delivery. You only need to prove the defect exists.
- You may choose between repair and replacement of the goods. Bringing the goods into conformity is free of charge for you and takes place within 30 days of your request.
- If bringing the goods into conformity is impossible or does not take place under these conditions, you may obtain a price reduction or termination of the sale, with a refund in exchange for returning the goods.
- Goods repaired under the legal guarantee of conformity benefit from a 6-month extension of that guarantee.
- If you chose repair and we replace the goods instead, a new 2-year legal guarantee of conformity applies to the replacement goods.
Guarantee against hidden defects
Under articles 1641 to 1649 of the French Civil Code, you may take action within 2 years of discovering a hidden defect that makes the goods unfit for their use. You may then choose between a price reduction and a refund in exchange for returning the goods.

11. Mediation

12. Personal data
Data collected when you place an order is processed in accordance with our privacy policy.
13. Governing law
These terms of sale are governed by French law, without prejudice to any more protective mandatory provisions of the law of your country of habitual residence.
